Our client was involved in a serious motor vehicle accident while driving a van for his job. He made a left turn and failed to yield to an oncoming tractor-trailer. His van rolled several times before landing on its wheels. When it came to a stop, it quickly ignited and caught on fire. Our client was unable to exit the flaming vehicle on his own and required help from brave passersby.

This traumatic accident left our client with severe burns to more than 50 percent of his body. He also suffered cracked ribs and a punctured lung and was placed in a medically-induced coma at Grady Memorial Hospital. He required extensive medical treatment and ongoing care.

Our client was determined to be at fault in the accident. However, he was still entitled to benefits as an injured worker. Workers’ compensation is a no-fault system. In other words, the question of fault is not usually at issue when figuring out an injured employee's eligibility for benefits.
